Privacy Policy

Article 1 (Purpose)



These Terms of Use (“Terms”) set forth the rights, obligations, and responsibilities between the online shopping mall operated by HANDRIX Co., Ltd. (the “Company”) and users in connection with the internet-related services (the “Services”) provided by the Company’s online mall (the “Mall”).
These Terms also apply, to the extent not contrary to their nature, to electronic commerce conducted via PC communication or mobile devices.



Article 2 (Definitions)



  1. “Mall” means a virtual place of business set up by the Company to enable users to trade goods and/or services (“Goods, etc.”) using computers or other information and communication equipment, and also refers to the business operator that runs the Mall.
  2. “User” means a member or a non-member who accesses the Mall and receives Services in accordance with these Terms.
  3. “Member” means a person who has registered with the Mall and can continuously use the Services provided by the Mall.
  4. “Non-member” means a person who uses the Services without membership registration.


Article 3 (Posting, Explanation, and Amendment of Terms



  1. The Mall shall post these Terms, the trade name and representative’s name, business address (including the address for customer complaints), telephone number, fax number, e-mail address, business registration number, mail-order business report number, and personal information protection officer on the initial service screen of the Mall for Users to easily view. The content of the Terms may be made available via a linked page.
  2. Before obtaining User consent, the Mall shall provide a separate linked or pop-up screen highlighting key matters such as withdrawal of offer, delivery responsibility, and refund conditions so that Users can fully understand them.
  3. The Mall may amend these Terms to the extent that it does not violate applicable laws, including the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, and the Framework Act on Consumers.
  4. When amending the Terms, the Mall shall announce the effective date and reasons for amendment alongside the current Terms on the Mall’s initial screen from at least seven (7) days prior to the effective date until the day before such date. If the amendment is unfavorable to Users, a grace period of at least thirty (30) days shall be provided. In such case, the Mall shall clearly compare and display the previous and revised provisions.
  5. The amended Terms apply only to contracts executed after the effective date; contracts already executed shall be governed by the previous Terms. However, if a User who has already executed a contract expresses intent within the notice period under Paragraph 4 to be governed by the amended Terms and the Mall agrees, the amended Terms shall apply.
  6. Any matters not provided herein and the interpretation of these Terms shall be governed by applicable laws and customary practices, including the Act on the Consumer Protection in Electronic Commerce and the guidelines of the Korea Fair Trade Commission.


Article 4 (Provision and Change of Services)



  1. The Mall performs the following:
    (1) Provision of information on Goods, etc., and execution of purchase contracts;
    (2) Delivery of Goods, etc., for which a purchase contract has been executed;
    (3) Other services determined by the Mall.
  2. If Goods, etc., are out of stock or technical specifications change, the Mall may change the content of Goods, etc., to be provided under future contracts, and shall immediately announce the changed content and provision date at the place where current content is posted.
  3. If the Mall changes contracted Services due to out-of-stock or specification changes, it shall promptly notify the User at an address where the User can be reached.
  4. In such cases, the Mall shall compensate the User for damages caused thereby; provided, however, that this shall not apply if the Mall proves no intent or negligence.


Article 5 (Service Interruption)



  1. The Mall may temporarily suspend Services in case of maintenance, replacement, breakdown of information and communication facilities, or disruption of communication.
  2. The Mall shall compensate Users or third parties for damages caused by temporary suspension of Services under Paragraph 1; provided that the Mall shall not be liable if it proves no intent or negligence.
  3. If Services cannot be provided due to change of business items, discontinuation of business, or merger, the Mall shall notify Users pursuant to Article 8 and compensate consumers in accordance with the conditions originally presented by the Mall. If no compensation standards are announced, mileage or points shall be paid in goods or cash corresponding to their monetary value in the Mall.


Article 6 (Membership Registration)



  1. A User applies for membership by filling out the registration form prescribed by the Mall and indicating consent to these Terms.
  2. The Mall shall register applicants as Members unless any of the following applies:
    (1) The applicant previously lost membership under Article 7(3), except where re-registration is approved by the Mall after three (3) years;
    (2) False, omitted, or erroneous entries are found.
    (3) Registration is significantly impeded due to technical reasons of the Mall.
  3. The membership agreement is deemed concluded when the Mall’s acceptance reaches the Member.
  4. If registered information changes, the Member shall notify the Mall within a reasonable period by editing the member information.


Article 7 (Withdrawal from Membership and Loss of Qualification)



  1. Members may request withdrawal at any time, and the Mall shall promptly process such request.
  2. The Mall may restrict or suspend membership if a Member:
    (1) Registered false information at sign-up.
    (2) Fails to pay the price of Goods, etc., or other debts related to the use of the Mall by the due date.
    (3) Disturbs others’ use of the Mall or steals information, thereby disrupting e-commerce order.
    (4) Violates laws or these Terms, or acts against public order and morals using the Mall.
  3. If the same act is repeated twice or more, or the cause is not remedied within thirty (30) days after restriction/suspension, the Mall may revoke membership.
  4. When revoking membership, the Mall shall delete the registration and notify the Member, granting at least thirty (30) days to present an explanation before deletion.


Article 8 (Notice to Members)



  1. Notices to Members may be given to the e-mail address designated in advance with the Mall.
  2. For notices to an unspecified number of Members, posting on the Mall’s bulletin board for at least one (1) week may substitute individual notice; provided that matters materially affecting a Member’s transaction shall be notified individually.


Article 9 (Purchase Application and Consent to Provision of Personal Information)



  1. Users apply for purchase on the Mall through methods similar to the following, and the Mall shall clearly present the following during the purchase process:
    (1) Search and selection of Goods, etc.
    (2) Entry of recipient’s name, address, phone number, e-mail (or mobile) number
    (3) Confirmation of Terms, restrictions on withdrawal, delivery fees/installation fees, etc.
    (4) Indication of consent to these Terms and confirmation/denial of the matters in item
    (5) Submission and confirmation of purchase application, and consent to the Mall’s
    confirmation;
    (6) Selection of payment method.
  2. When providing a purchaser’s personal information to a third party, the Mall shall inform and obtain consent regarding: (1) recipient; (2) purpose of use; (3) items provided; and (4) retention/use period. The same applies to any changes.
  3. When outsourcing the processing of personal information, the Mall shall inform and obtain consent regarding: (1) the trustee; and (2) the details of the outsourced
    work. However, if necessary for contract performance or for user convenience, notification through the privacy policy under the Information and Communications Network Act may replace individual notice and consent.


Article 10 (Formation of Contract)



  1. The Mall may refuse a purchase application if:
    (1) the application contains false, omitted, or erroneous information;
    (2) a minor applies to purchase prohibited items under the Juvenile Protection Act (e.g., tobacco/alcohol);
    (3) acceptance is significantly impeded due to technical reasons of the Mall. In the case of minors, the Mall shall notify that the contract may be cancelled by the minor or legal representative if consent of the legal representative is not obtained.
  2. A contract is formed when the Mall’s acceptance reaches the User in the form of an order-receipt confirmation under Article 12(1).
  3. The Mall’s acceptance shall include information confirming the User’s application, availability of sale, and correction/cancellation procedures.


Article 11 (Payment Methods)



Users may pay for Goods, etc., purchased through the Mall by any available electronic methods below, and the Mall shall not charge any additional fees on
account of the chosen method: bank transfers (including phone/online banking), prepaid/debit/credit cards, online deposit without passbook, electronic money, payment on delivery, Mall points/mileage, gift certificates recognized by the Mall, and other electronic payment methods.



Article 12 (Receipt Confirmation; Change and Cancellation of Purchase Application)



  1. Upon a purchase application, the Mall shall send a receipt confirmation to the User.
  2. Upon receiving the confirmation, the User may request changes or cancellation if there is any inconsistency in intent; the Mall shall process such request without delay before shipment. If payment has already been made, Article 15 shall apply.


Article 13 (Supply of Goods, etc.)



  1. Unless otherwise agreed, the Mall shall take necessary measures such as order production and packaging to deliver Goods, etc., within seven (7) days from the User’s application. If full or partial payment has been received, measures shall be taken within three (3) business days from receipt of such payment. The Mall shall provide means for Users to check the supply procedure and status.
  2. The Mall shall indicate the delivery method, who bears the delivery fee by method, and delivery period by method. If the agreed period is exceeded, the Mall shall compensate the User for damages unless the Mall proves no intent or negligence.


Article 14 (Refunds)



If the Mall is unable to deliver Goods, etc., due to out-of-stock or other reasons, it shall promptly notify the User and, if payment was received in advance, refund within three (3) business days or take necessary measures for refund.



Article 15 (Withdrawal of Offer, etc.)



  1. A User who has executed a purchase contract may withdraw the offer within seven (7) days from receipt of the contract document under Article 13(2) of the E-Commerce Consumer Protection Act (or from receipt/start of supply if later). If otherwise provided by said Act, such provisions prevail.
  2. Returns/exchanges are not available if:
    (1) the Goods, etc., are lost or damaged due to reasons attributable to the User (except damage to packaging necessary to check the content);
    (2) the value is significantly diminished due to use or partial consumption by the User;
    (3) the value is significantly diminished due to lapse of time making resale difficult;
    (4) in case of duplicable Goods with the same performance, the original packaging is damaged.
  3. Paragraphs (2)(2) (4) do not limit withdrawal if the Mall did not clearly indicate such restrictions in advance or provide samples.
  4. Notwithstanding Paragraphs 1 and 2, if the Goods, etc., differ from labelling/advertisement or the contract is performed otherwise, the User may withdraw within three (3) months from supply or within thirty (30) days from the date the User knew or could have known such fact.


Article 16 (Effects of Withdrawal)



  1. Upon return of Goods, etc., the Mall shall refund the price within three (3) business days. If delayed, the Mall shall pay delay interest calculated under Article 21-2 of the Enforcement Decree of the E-Commerce Consumer Protection Act.
  2. If payment was made by credit card or electronic means, the Mall shall promptly request the payment provider to stop or cancel the charge.
  3. Return shipping costs are borne by the User in case of withdrawal; the Mall shall not claim liquidated damages or compensation for such reason. However, if withdrawal is due to reasons attributable to the Mall (e.g., discrepancy with labelling/advertisement), the Mall shall bear the return cost.
  4. If the User bore shipping at receipt, the Mall shall clearly indicate who bears the cost upon withdrawal.


Article 17 (Protection of Personal Information)



  1. The Mall collects the minimum personal information necessary to provide Services.
  2. The Mall does not collect in advance information necessary for contract performance at the time of membership registration, except where identity verification is required by law.
  3. The Mall shall notify Users of the purpose of collection/use and obtain consent when collecting/using personal information.
  4. The Mall shall not use collected personal information for purposes other than those notified, and shall obtain consent when the purpose changes or when providing it to third parties, unless otherwise required by law.
  5. Where consent is required, the Mall shall specify the personal information officer’s identity and contact details, the purpose of collection/use, and third-party provision details as prescribed by law; Users may withdraw consent at any time.
  6. Users may request access/correction of their personal information at any time, and the Mall shall take necessary measures without delay; during correction, the information shall not be used.
  7. The Mall shall minimize personnel handling personal information and is responsible for damages from loss, theft, leakage, unauthorized provision, or alteration of Users’ information, including credit card/bank details.
  8. The Mall or any third party that received personal information shall promptly destroy it upon achieving the purpose of collection/provision.
  9. The Mall shall not pre-check consent boxes for collection/use/provision, shall specify any service limitations upon refusal, and shall not reject service or membership solely due to refusal to provide non-essential information.


Article 18 (Obligations of the Mall)



  1. The Mall shall not engage in acts prohibited by law or contrary to public morals and shall use best efforts to provide Goods/Services continuously and stably as prescribed herein.
  2. The Mall shall establish a security system to protect Users’ personal information (including credit information).
  3. If the Mall causes damage to Users through unfair labelling/advertising under the Act on Fair Labelling and Advertising, it shall be liable for compensation.
  4. The Mall shall not send unsolicited commercial e-mails against the User’s will.


Article 19 (Member’s ID and Password)



  1. Except as provided in Article 17, the Member is responsible for managing the ID and password.
  2. Members shall not allow third parties to use their ID and password.
  3. If a Member becomes aware of theft or unauthorized use, the Member shall immediately notify the Mall and follow its guidance.


Article 20 (User Obligations)



Users shall not:
(1) register false information at application or change;
(2) steal others’ information;
(3) alter information posted on the Mall;
(4) transmit/post information (e.g., computer programs) other than that set by the Mall;
(5) infringe the intellectual property rights of the Mall or third parties;
(6) defame or interfere with the business of the Mall or third parties;
(7) post or disclose obscene or violent messages, images, audio, or other information contrary to public order and morals.



Article 21 (Relationship between Linked and Linking Malls)



  1. If the upper Mall and lower Mall are connected by hyperlink (including text, images, and videos), the former is a “linking Mall” and the latter a “linked Mall.”
  2. If the linking Mall clearly states on the initial screen or at the time of connection that it does not guarantee transactions conducted by the User based on Goods, etc., independently provided by the linked Mall, it shall not bear guarantee liability for such transactions.


Article 22 (Copyright Ownership and Restrictions on Use)



  1. Copyrights and other intellectual property rights to works created by the Mall belong to the Mall.
  2. Users shall not use, for profit or allow third parties to use, information obtained through the Mall to which the Mall holds intellectual property rights, without prior consent of the Mall.
  3. Where the Mall uses copyrights owned by a User pursuant to an agreement, the Mall shall notify the User.


Article 23 (Dispute Resolution)



  1. The Mall shall operate a damage compensation handling body to reflect and handle legitimate opinions or complaints raised by Users.
  2. The Mall shall give priority to handling complaints and opinions submitted by Users; if prompt handling is difficult, the Mall shall immediately notify the reason and schedule.
  3. If a User files for dispute mediation regarding an e-commerce dispute with the Mall, mediation by the dispute mediation body referred by the Korea Fair Trade Commission or the heads of Si/Do may be followed.


Article 24 (Jurisdiction and Governing Law)



  1. Litigation concerning e-commerce disputes between the Mall and Users shall be brought to the court having jurisdiction over the User’s address at the time of filing; if unknown, to the court with jurisdiction over the User’s residence; for foreign residents or if both are unclear, to the competent court under the Civil Procedure Act.
    2.Korean law shall govern e-commerce lawsuits between the Mall and Users.
